Right of use
You may download the pictures displayed in the Image Gallery for private purposes. It is prohibited for you to use the pictures or data for business or other professional or commercial purposes. You are required to include a reference in each case to the originator - the photographer, in as far as you wish to make the pictures or data accessible to third parties. You are not permitted to use the Image Gallery for illegal or improper purposes. You are required to notify Olympus without delay if you should discover images or data in the Image Gallery which contravene the law, offend against public decency, or are in breach of contracts known to you. You hereby agree to indemnify Olympus from and against all claims made by third parties in connection with the Image Gallery, if you yourself contravene the terms of use.
Information concerning the Picture Gallery and its use
The pictures, images and data placed in the Picture Gallery are not continually controlled or monitored by Olympus. The possibility cannot be ruled out that pictures, images or data have harmful structures, in particular, are infected with viruses or similar. The person identified in each case as the one inserting the item or the photographer is solely responsible for the images and data. The pictures, images and data do not reflect the opinion of Olympus, nor does Olympus make assertions in this respect.
Make a back-up copy of your data as stored at that time on your computer, in each case before you access the Image Gallery and where applicable, download, in order to keep damage as slight as possible on any loss of data. In addition, use the latest version of a virus protection program.
Limitation of liability
Olympus does not undertake any liability for uninterrupted availability and functional reliability of the Image Gallery, nor for damage arising from downloading images or data, in particular, where caused by viruses or similar. The same applies to possible delays or data loss during use or during the transmission of pictures or data. Further, Olympus does not accept liability for the content of Web sites which do not form part of the Image Gallery, but do refer to a link. Olympus is not in a position to control or guaranty the content and availability of such linked Web sites.
Mandatory statutory provisions remain unaffected, irrespective of the limitations on liability stated.
Accordingly, Olympus accepts liability whatever the legal grounds without exception for such damage as is caused wilfully or through gross negligence by Olympus, its legal representatives or executives. Notwithstanding the foregoing, Olympus accepts liability for slight negligence in cases of breach of material contractual duties. However, liability for breach of material contractual duties shall be limited to foreseeable damage, typical of contract. For such damage only, Olympus shall be liable in cases of grossly negligent breach of non-material contractual duties.
In the event of death, physical injury or impairment of health, as well as in cases of liability under the German Product Liability Act ("Produkthaftungsgesetz") and wilfulness Olympus´ liability shall correspond without limitation to the statutory provisions.
Olympus shall only be liable for all other damage in accordance with the stated conditions, including that which has not been expressly mentioned. Otherwise, liability is excluded.
Miscellaneous
You declare that you have accepted the general conditions for use of the Web site, more particularly, in respect of industrial property rights and data protection, unless otherwise agreed above.
